Matters of significance in which Hwai Bin has been involved in include acting for the following:

• Relationship and Key/Lead Partner in front-end documentation and project advisory for a government procurement entity / authority in respect of numerous health and medical infrastructure and facilities in Singapore.

​

• Huntsman Corporation, one of the largest chemical manufacturers in the U.S., on the construction of a new US$40 million JEFFAMINE® polyetheramines manufacturing facility located in Jurong Island, Singapore with an annual capacity of 15,000 tonnes per annum.

​

• A Logistics Company and Contractor in a successful arbitration, concerning termination of a sub-contract for the design, supply and installation of overhead cranes, rescission and compensatory costs for the sub-contractor’s breaches. The sub-contractor applied unsuccessfully to set aside the arbitral award on grounds of fraud, breach of natural justice and public policy. Reported judgment: CLX v CLY and another and another matter [2023] 4 SLR 241

•  A global integrated solutions provider of airport logistics systems, in an international arbitration under the Rules of Arbitration of the ICC, against a Danish company, where the main issue involved the consequences arising out of a wrongful termination of a contract for the design, construction and completion of the baggage handling system works for an international airport, with the contested quantum in the arbitration exceeding US$41 million.

• One of the largest Offshore and Marine fabrication shipyards in the world, in Singapore Court proceedings involving application for an injunction to restrain payment out on a performance bond, challenging the validity of the performance bond, and stay of High Court proceedings in another Suit and an arbitration administered by the SIAC where the central issue involved the consequences arising out of the termination of a shipbuilding contract. The arbitration involved a Dutch shipping company and disputed claims exceeding S$70 million.

• One of PRC’s largest mechanical and electrical equipment manufacturers in an international arbitration under the ICC Rules and administered by the SIAC. The arbitration arose from a disputed termination of a contract (governed by English law) for the construction of a power plant in West Java, Indonesia, and involved claims exceeding US$230 million.

• Management Corporation Strata Title Plan No 2297 v Seasons Park Ltd [2005] 2 SLR(R): Court of Appeal decision affirming the applicability of the “independent contractor” defence in a claim in tort of negligence by the MCST against the Developer in respect of defects. 

​

• Jurong Town Corporation v Wishing Star Ltd [2005] 3 SLR (R) 283 and [2005] 1 SLR (R) 339: Court of Appeal decision on misrepresentation and right to rescind contract for misrepresentation. 

​

• JK Integrated (Pte Ltd) v 50 Robinson Pte Ltd and another [2015] SGHC 57: High Court decision on restraining the call on a performance bond. 

​

• Libra Building Construction Pte Ltd v Emergent Engineering Pte Ltd [2016] 1 SLR 481; [2015] SGHC 279: A landmark High Court decision which laid down the principle that only one payment claim can be served in a reference month under the SOP Act.

• Far East Square Pte Ltd v Yau Lee Construction (Singapore) Pte Ltd [2019] 2 SLR 189: Court of Appeal decision on right to present a payment claim post-issuance of the Final Certificate and whether there was a duty to raise any objections in the payment response.

• Jin Ling Enterprise Pte Ltd v E C Prime Pte Ltd [2019] SGHC 209: A High Court decision involving  claims for alleged misrepresentation by a developer in the sale and purchase of commercial units, valued over S$12 million.
